AN ACT to enable the parish of St. Andrew in Tyrril County and the South west parish of Pasquotank County to Elect Vestrys Whereas the Several Vestrymen and Church Wardens elected on Easter monday next before the passing of this Act in and for the parish of St. Andrew in Tyrril County and the Vestrymen elected on the same day in and for the parish called the So. West parish of Pasquotank have neglected to take the Oaths by Law directed to be taken for the qualification of Vestrymen and Church Wardens and by their neglect to take the said Oaths have disabled themselves to Act as Vestrys and Whereas by the laws now in force in this province the Inhabitants of the said Parishes have no power to choose Vestrymen in the room of the Persons so disabled to act untill Easter Monday which will be in the Year of our Lord one thousand Seven hundred and forty two and therefore the said Parishes must remain without Vestrys to that time which will be very prejudicial to the Inhabitants of the said Parishes for prevention whereof Be it Enacted by his Excellency the Governor the Council and General Assembly of this province that the Inhabitants of the said Parish of St. Andrew who are qualified to vote for vestrymen shall meet together on the first Tuesday in September next ensuing the passing of this Act at the Court House of Tyrril County and the Inhabitants of the said parish are hereby authorized then and there to Elect Vestry men and Church Wardens for the said parish in the manner as the laws now in force for that purpose direct and the Inhabitants of pasquotank County shall meet qualified to vote for Vestry men shall Assembly on the first Tuesday in September next after the passing of this Act at the Court House in the said parish and the said Inhabitants shall then and there Choose Vestrymen and Church Wardens for their parish and each person who shall be ellected Vestrymen and Church Warden by Virtue of this Act shall take the Oaths by law directed to be taken by Vestrymen and Church Wardens within ten days after he shall be ellected and in case of default to take the said Oaths shall be incapable to Act as a Vestryman or Church Warden and a Vestryman or Church Warden shall be ellected to Serve in the Stead of the person so disqualified in the manner as the laws now in force in this province in such cases direct. And be it Enacted by the Authority aforesaid that the Vestrymen and Church wardens who shall be Elected for the said two parishes by Virtue of this Act shall have full power and authority to Act as Vestries and Church wardens for their respective parishes untill Superseded according to Law and shall have full power to lay levys and to do all other Acts which by Law can be done by any Vestry of this Province elected according to the Act of Assembly passed in General Assembly of this province in the Year of our Lord one thousand Seven hundred and twenty nine for regulating of Vestries. And whereas the Vestrys of the said two parishes which were ellected on Easter monday in the Year of our Lord one thousand Seven Hundred and thirty Eight have neglected to lay a levy on the Inhabitants of their respective parishes for payment of the reward due for killing Vermine within their respective parishes and for payment of Readers and other parish Services Be it Enacted by the Authority aforesaid that each Vestryman which shall be Elected by Virtue of this Act shall and are hereby Authorized to lay Levys for the payment of such sums of money which are in Arrear and which ought to have been paid in the time of their predecessors for parish Services and to cause the same to be Collected according to law and to pay therewith the Several Sums due to all persons for Services done to their respective parishes.
