AN ACT Appointing a Treasurer for the Several Countys herein Mention'd in the Room of William Downing Esqr. Deceased


Be it Enacted by his Excellency the Governour and Council and General Assembly of this Province

And it is hereby Enacted by the Authority of the same that John Hodgson Esqr. shall be and is hereby Nominated Constituted and Appointed Treasurer of the publick Moneys or Revenues Arising by Virtue of an Act Intituled An Act to prevent the Concealment of Tithables in the Several Countys within this province for declaring what persons shall be deemed Tithables and laying a pol Tax for defraying the standing and Contingent Charges of this Government and appointing publick Treasurers in this Province in the Counties of Chowan perquimons pasquotank Currituck, Bertie Edgecombe, Tyrell Beaufort and Hyde. And the said Treasurer is hereby Authoriz'd impowered and required to demand receive and take of and from the Sheriff or Sheriffs and of and from every Collector or Collectors all and every sum and summs of Money arising by force of the before recited Act of Assembly And the said John Hodgson is hereby Authorized and required to keep and retain all such Money in his own Custody and possession untill he shall dispose of the same in such Manner and by such Warrant and for such Uses intents and purposes and no other than are Limited directed and Appointed in the said Act.

And be it Further Enacted by the Authority aforesaid that it shall and may be lawfull for the said Treasurer to take and keep to himself Six per Cent out of all and every Sum and Sums of Money by him received and Accounted for According to the directions of the said Act.

And be it Further Enacted that the said John Hodgson before his entry and Admission into the said Office of Treasurer and taking upon him to Execute and Manage the same shall give Bond with Good and Sufficient Security for the true and just performance and discharge of the said Office According to the true Intent and Meaning of the before recited Act of Assembly.

Provided always that in Case of death departure out of the Government or other Legal disability of the Treasurer hereby Appointed it shall and may be Lawfull for the Governour or Comander in Chief for the time being to Appoint such other person as he shall think fitt to Execute the said Office untill the Next Session of Assembly, According to the directions and Intent of the before recited Act of Assembly.
