AN ACT To Regulate the Act for Appointing Indifferent Jurymen and to Repeal that Part thereof that Referes to Precinct Courts Whereas it hath been found very burthensome for People in the Remotest part of the Government to attend the General Court and no Fee or reward allowed for the Same Be it Therefore Enacted by the Authority aforesaid That for the future Every petit Juryman attending the General Court shall be allowed five shillings per Diem for their Attendance, and also five shillings per Diem allowance to be made for their travelling the Distance for Each day to be Reckoned as is allowed a Days Travell to the Burgesses From Each precinct and that the penalty for not Appearing and attending the Court shall be five pounds to be recovered by an Order of the Justices of the General Court to be applyed to and for the use of the Publick and to be Accounted for with the next Assembly. And Be it further Enacted by the Authority aforesaid that for the future no Grand Jurors shall be impanneled to Serve on any Grand Jury but Such as are in the following List of Jurymen, and that allowance be made to Each of the Grand Jury five shillings per Diem for Travelling according to their Distance to be Reckned as before is provided for the petty Jury, and that the Allowance hereby provided shall be paid by the Publick Treasurer he producing a Certificate from the General Court, Containing the Number of Days he Served. And Be it Further Enacted by the Authority aforesaid that the said Act for providing Indifferent Jurymen so farr as relates to precinct Courts, shall be and hereby is, and Stands Repealed to all Intents and purposes. And for the more speedy Advancement of Justice and to prevent great Charges and Delays of tryals in the General Court We pray that It may be Enacted And it is hereby Enacted by the Authority aforesaid That the Act Intituled an Act for Enlargeing and Confirming the Jurisdiction of the Precincts may be and Continue two years Longer and from thence till all such Actions are brought be Vertue of this Law till the Same are finally Determined and finished. And be it further Enacted by the Authority aforesaid that all petty Jurors hereafter to be drawn to Serve for the General Court of this province shall be drawn out of Such List as to be formed from the Lists to this Act Annexed and the other Lists annexted to the Act Entituled an Act, to provide Indifferent Jurymen in all Causes Civil and Criminal. And be it Further Enacted by the Authority aforesaid that Each and Every Marshal or Deputy Marshal for the better Encouraging them in their due observance in Summoning the Jurymen aforesaid shall and may Receive for Each and Every Juryman he shall Return to the General Court Summoned according to the Direction in the Act receive two shillings and Six pence out of the treasury for each and Every Juryman so Summoned and Returned of the original panel.
