AN ACT for Encouraging and facilitating Navigation in this Province Whereas Ochacock Inlett is found to be a good Inlett and to be usefull for Vessells passing in and out of both Albemarle and Bath Countys whereas there is a very safe Harbour within that Inlett Called Thatches Hole where there is a place convenient for Landing or putting on Shore Goods when there is a Necessity of Vessells Lightening to pass over the Shoals in Pamplico Sound and also of Watering, the Soil whereof Belonging to Some of the Inhabitants of this Government it may be doubted that they may hinder Masters of Vessells from putting Goods on Shoar there, or that they may Exact too largely therefore, which would prove a Discouragement to Trade; for Prevention whereof and that Navigation may be Encouraged Be it Enacted by his Excellency the Palatine and the rest of the true and Absolute Lords Proprietors of the province of Carolina by and with the Advice and Consent of the rest of the Members of the Generall Assembly now met at Edenton for the North East part of the said Province That Twenty Acres of Lands which shall be adjudged to lye most Convenient for the purposes aforementioned shall by the Commissioners hereafter mentioned with the Assistance of a Surveyor be laid out for that purpose at the place aforesaid For which Lands when so laid out for the Uses aforesaid the Owners shall be Entituled to demand and receive out of the publick Treasury from the Publick Treasurer the Summ of Five Pounds and the aforesaid Twenty Acres of Land when so laid out are hereby declared to be and shall by Virtue of this Act be appropriated to and for the Uses of Mariners going or about to go with Vessells in or out of this Government unlade, or put on Shore any goods Wares or Merchandize or any Utensils belonging to their said Vessells or about to be Carried out in them, and to build Tents or Cabins thereon for Securing or Sheltering the same if need be, and again at pleasure to take of anything by them so landed or put on Shore without the Lett or Molestation of any person or persons whatsoever. Provided Nevertheless and it is to be understood that the aforesaid Five pounds to be paid to the Owners of the aforesaid Twenty Acres of Land is for and in Consideration of the Uses aforesaid perpetually to be had of the aforesaid Twenty Acres of Land and the watering thereon and not in Consideration of the Fee of the aforesaid Twenty Acres of Land which shall be and remain to the Owners or to their Assigns any thing in this Act to the Contrary notwithstanding. And be it further Enacted by the Authority aforesaid That Mr. Jno. Snoad Mr. Simon Alderson, Mr. Thomas Henderson and Mr. Josias Jones or any two of them be and they are hereby Nominated and Appointed Commissioners for laying out the said Twenty Acres including the Watering place and excluding the house now standing near the place aforesaid.
