AN ACT to establish and confirm John Hodgson Esqr. Treasurer of the Countys herein after mentioned


Whereas by an Act of Assembly ratified by his Excellency the Governor at the last Session of Assembly held at Newbern the said John Hodgson was nominated and Appointed publick Treasurer in the room of William Downing Esqr. Deceased of the revenues or taxes arising by an Act Intituled an Act to prevent the concealment of Tithables in the Several Countys within this province for declaring what persons shall be deemed Tithables and for defraying the Standing and contingent charges of Government and appointing publick Treasurers in this province and for granting to his Majesty a poll Tax of five Shilling per head Current money to be levied on the Tithable Inhabitants of this province for the Countys of Chowan pequimons pasquotank Currituck Bertie Edgcome Tyrril Beaufort and Hide and disputes having arisen about the manner of passing the said Act and the Validity thereof to prevent any further controversy or dispute thereon We pray it may be enacted

And be it Enacted by his Excellency the Governor by and with the advice and consent of his Majesty's Council and General Assembly that the said John Hodgson shall be and is hereby nominated Constituted and appointed and confirmed Treasurer of the monies revenues or tax arising by Virtue of the said Act and to be paid out of and for the Countys aforesaid and the said Treasurer is hereby authorized empowered and required to demand receive and take of and from every Collector and Collectors all and every the Sum and Sums of Money arising by force of the before recited Act of Assembly and the said John Hodgson is hereby authorized and required to keep and retain all such money in his own Custody and possession untill he shall dispose of the same in such manner and by such warrant and for such uses Intents and purposes and to no other as are Limited directed and appointed in the said Act.

And be it further Enacted by the Authority aforesaid that the Salary of Six per Cent shall be allowed and paid to the said Treasurer out of all and every Sum and Sums of money by him received and accounted for to the General Assembly according to the directions of the said Act.

And be it further Enacted that the Bond and Security allready given by the said John Hodgson for the true and just performance and discharge of the said Office and place of Treasurer shall continue and remain in full force and that all money paid to him by Virtue of such first appointment shall be deemed duly paid and that all and every Act and Acts which he hath done by Virtue of his said Office shall be deemed good and valid to all Intents and purposes whatsoever.

Provided always that in case of the death departure out of the Province or other Legal disability of the Treasurer here by appointed that then it shall and may be lawfull to and for his Excellency the Governor or Commander in Chief for the time being with the advice of his Majesty's Council to appoint and constitute such other person as he shall think fit to execute the said Office of Treasurer according to the several rules and directions in this Act expressed who shall have hold and enjoy the said Office of Treasurer with all the Rights and profits to the said Office belonging untill the then next Session of Assembly giving such bond and Security as herein before directed any thing in this Act or any other Act to the contrary in any wise notwithstanding.
